Terms of service

These terms are the agreement between you and Eatomatic for use of the restaurant operating system — websites, guest QR, waiter and kitchen apps, manager desk, franchise HQ, SpiceBot, billing and related services.
The agreement
By creating an account, starting a plan, or using Eatomatic, you agree to these terms and to the Privacy policy. If you use Eatomatic for a restaurant or a brand, you confirm you can bind that business.
If you do not agree, do not use the service.
What Eatomatic is
Eatomatic is software-as-a-service for restaurants. Guests scan a table QR, order and pay. Staff run the floor on a phone. The kitchen sees live tickets. The manager opens and closes the day, edits the menu, watches live orders, staff, stock, analytics, food rescue, table actions and support. Franchise HQ sits on top of outlets. SpiceBot is the intelligence layer inside that system.
We do not replace your duty to serve food safely, to collect the right tax, or to hold licences (including FSSAI where required). We do not sell hardware as the default product. A browser, phones you already carry, and a kitchen screen are enough to start.
Accounts and access
You must give true signup and KYC information. Keep passwords and OTPs to yourselves. You are responsible for staff you add and for what they do in the product.
We may suspend an account that looks compromised, unpaid, abusive, or used to break the law. Operations closed in the product means guests cannot order on QR — that is by design.
Plans, fees and taxes
Subscription plans (including a free tier on a limited number of tables, and paid Dine, Grow, Scale and franchise rungs) are described on the Pricing page. Features depend on the plan you are on.
Guest checkout may include a platform fee and, where configured, a commission. Those amounts are shown in the product and on the bill. Subscription GST, if applicable, is added as required by law.
We may change list prices for new terms. We will not rewrite a current paid term silently. Unpaid invoices may pause payouts or the workspace after notice.
Your restaurant's job
You are responsible for:
- Menu prices, photos, veg tags, allergens you choose to show, and whether a dish is available.
- GST, VAT and service charge settings, and the tax invoices the system produces from those settings.
- Staff conduct, attendance you record, and tips you assign.
- Food safety, licences and the food you donate through Food Rescue — listings must be lawful and fit to give away.
- How you treat guest data in your outlet, including reviews and loyalty.
Guests
A guest who scans your QR uses Eatomatic as your ordering and payment screen. Their contract for the meal is with you. Their payment is taken as the product is configured (UPI, card, cash). Service requests from the table (waiter, water, bill and the rest) are messages to your staff, not to us as the diner's waiter.
Payments
Card and UPI charges go through Razorpay and, where used, Stripe. Settlement to your linked account follows those providers' rules and your KYC status. We may pause payouts for a restaurant or for the platform when needed to stop fraud or to follow the payment partner.
Refunds, chargebacks and complimentary bills are handled as the product allows and as the payment partner requires. You remain responsible for guest disputes about the meal.
SpiceBot
SpiceBot output is assistance, not a certificate. Briefings, forecasts, menu copy, translations and review reads can be wrong. You decide what to serve, what to price and what to tell a guest. Do not rely on SpiceBot as legal, tax or medical advice.
Acceptable use
You may not: probe or overload the service; scrape other restaurants; impersonate Eatomatic; process card data outside the payment fields we provide; use the product for anything illegal; or attempt to access another outlet's data.
Intellectual property
Eatomatic, SpiceBot and the software are ours (and our licensors'). You keep your menu, logos, guest lists and the content you upload. You give us a licence to host that content solely to run the product for you, including showing it on the guest QR and at franchise HQ if you use those features.
Availability
We aim to keep Eatomatic up through service. We do not promise uninterrupted access. Billing downtime is designed not to kill the floor where the product already fail-opens orders; that is not a warranty that every failure mode is covered. Schedule maintenance when we can.
Liability
To the extent Indian law allows, Eatomatic is provided as available. We are not liable for lost profit, lost data, kitchen delays, or guest dissatisfaction except where we cannot exclude liability (for example proven fraud, or death or personal injury caused by our negligence, as the law provides).
Where we can limit liability, our total liability for a claim about the service is limited to the subscription fees you paid us for the three months before the claim. If you are on a free tier and paid us nothing, liability is limited to the maximum the law still requires us to keep.
Ending the service
You may stop using Eatomatic and close an account by writing to us. We may end or suspend the service for breach, non-payment, or if we shut the product down, with notice where reasonable. After closure we retain records as the Privacy policy and tax law require.
Law and disputes
These terms are governed by the laws of India. Disputes will be subject to the courts of India that have jurisdiction, unless a mandatory consumer or other forum applies to you.
